When do I need a Building Permit?

A building permit is required for the construction or alteration of any structure over 15 m² (161 ft²) in area. It is the responsibility of the property owner to ensure that a building permit is obtained prior to any construction taking place - it is illegal to begin construction without one. A building permit application and detailed construction drawings of the project must be submitted for approval prior to commencing with any construction work.

Construction projects that require a Building Permit include but are not limited to: 

  • any addition to an existing building
  • adding dormer(s) to the existing roof
  • structural alterations (such as window/door enlargements)
  • renovations, repairs or additions to a building
  • demolishing all or a portion of a building
  • changing a building's use (when no construction is being completed)
  • installing, changing, or removing partitions and load bearing walls
  • make new openings for, or change the size of, doors and windows
  • constructing a balcony
  • excavating a basement or constructing a foundation
  • installing or modifying heating or plumbing systems
  • installing or reconstructing chimneys or fireplaces
  • construction of a deck where any surface is greater than 24" above grade
  • installing a wood burning stove/fireplace 
  • installing a basement entrance
  • renovating any part of a home to include a second suite (Additional Dwelling Unit)
  • adding a bedroom to the basement
  • pending location, installing a retaining wall that is greater than 1m (3'-3") in height
  • erecting a tent or group of tents that is more than 60 m² (646 ft²) in aggregate area, attached to a building or constructed within 3m (9'-10") of any structure
  • installing a swimming pool with a depth of 0.91m (36") or greater (including temporary or inflatable pools)
  • Installation of solar panels 
  • Alterations to an existing  septic system
  • installation of a new or replacement septic system 
  • replacing a septic tank
  • construction of an accessory structure that meets any of these criteria:
    • over 15 m² (161 ft²) in size
    • more than one storey
    • attached to another structure
    • used for any purpose other than storage
    • contains plumbing

Generally building permits are not required for the following projects:

  • door and window replacements within the existing opening, where no structural members are change
  • fences unless installed around a swimming pool with a depth of 0.91m (36”) or greater (including temporary or inflatable); please note that any fences constructed on a property must comply with the regulations outlined in the Township Fencing By-law
  • installing a gas fireplace
  • replacing a roof
  • installing a water softener
  • finishing work such as painting, wall papering, tiling, carpeting, installation or replacement cabinets and countertop 
  • removing a non-load bearing wall
  • replacing a plumbing fixture (i.e. toilet, bathtub, or sink) with a new fixture in the same location
  • erecting a *structure less than 161 ft² measured from the outside face of walls (that does not contain plumbing)
  • deck not over 24” above grade at any point

*Note: the applicable zoning setbacks for the zone in which the structure is located must still be maintained, regardless of the structure not requiring a building permit
